General terms and condition of sale

1.   Purpose


The following terms and conditions aim to define the legal framework, the rigexcluding VATs and reciprocal obligations between the parties referred to hereafter, which will apply to any purchase made by email, phone, mail or through the web site

These terms and conditions concern consumers exclusively and do not apply to retailers.

Any user of the web site declares it has the legal capacity to place an order and use the payment method selected.


The user can at any time consult the general terms and conditions of sale located in the "information" section to the left of the screen by clicking on "General Terms and Conditions of sale and use".

When purchasing on the web site it is compulsory for the consumer to accept the general terms and conditions for confirmation of any order.


Etablissements KEKLIKIAN reserves the rigexcluding VAT to change the terms and conditions of sale at any time without notice. In this event, the conditions will be those in effect at the time of the order.


If any particular clause of these terms and conditions is held to be invalid or declared as such by a competent court, the other clauses remain in full force and effect.




The present particular conditions are applicable to the sale of products marketed on the website within the framework of “private sales K.Jacques”, which corresponding in a commercial operation from Friday, October 24th, 2020 till inclusive Monday, November 30th, 2020, exclusively accessible on the e-commerce website, during which K.Jacques products are proposed in a sale with limited quantities and while stocks last.

To place an order within the framework “Private sales K.Jacques”, the customer must necessarily have created an account on the website through the proposed form and inform the necessary fields.

Once the form was correctly filled, the customer is registered and can benefit of the “Private sales K.Jacques”.



2.   Products and availability.


The availability of the sandals shown on the web siteare sold in limited quantity, within the limits of the available stock.


Products in sale are from returns of: loan in the press, shooting, display in shop windows and fashion shows.

They are classified in 3 categories according to their states of wear:


-       New: Sandals are new. They have never been worn, tried on or labelled with any sticker.


-       Rubished Display models: Sandals could have been tried on in a showroom. The leather original colour could have been slightly altered due to display. Soles could have some light labelling marks.


-       Used Photoshoot models: Sandals have been worn during photoshoot sessions. Soles are marked. The upper sole could also have some marks on.



The order and delivery are confirmed only by us sending an email confirmation from the address


The products shown are photographed and described as faithfully as possible. However, depending on the browser and/ or screen used, the colours may not match the goods exactly.



 3. How to order through the web site?


A user who wishes to buy a product on the online shop must:


1) Fill in the identification form, entering all the information requested. A username and password will be assigned.

2) Select the item(s), or the size(s) and or the colour(s) desired;

3) Confirm your order by emptying the basket;

4) Make the payment in the terms provided.


The order and the delivery is confirmed by:


1) sending a confirmatory e-mail via, advising of the order going into production,

2) a second email informing you of the date of delivery, the package number and the carrier used.


We reserve the rigexcluding VAT to cancel or refuse any order from a customer with whom there is a dispute over payment of a previous order or where there is any suspicion of fraud.


The order data is stored on reliable and durable computer media. It is considered as evidence of the contractual relationship between the parties as well as any document, received or kept in writing.

The customer file is exclusively managed by Etablissements KEKLIKIAN.




4.   Rates Avaibility


The price of the items is stated in Euros or in Dollars (United States), excluding delivery costs. These are shown by default with VAT duties and taxes included. The rate will be recalculated by country of destination net of tax before confirmation of the order


-       Deliveries to mainland France and the European Union:

Rate applied: All taxes included ( VAT rate 20%


-       Deliveries to the overseas territories:

Rate applied: Net of tax (exclusive of tax). VAT and / or other duties will be payable by the recipient to the customs of the place of delivery.


-       Deliveries to countries outside the European Union:

Rate applied: Net of tax (exclusive of tax). VAT and / or other duties will be payable by the recipient to the customs of the place of delivery.


The products will be invoiced based on rates in effect at the time of the order registration. The products remain the property of Etablissement KEKLIKIAN until full payment is received. The price is payable in full and in one payment. 


Etablissement KEKLIKIAN reserves the rigexcluding VAT to change the prices at any time, except that the price listed in the catalogue on the day of the order shall be the only one applicable to the buyer.




5.   Deadlines and Delivery


Products ordered within the framework of “K.Jacques privates sales” on the website will be delivered by Colissimo (Postal service), Chronopost or Fedex depending on the country delivery and the customer selection.

The delivery in our K.Jacques shop, 39 Bis rue Allard in Saint-Tropez is available by appointment only.

5.1 What is the delivery time?


Orders placed before 11:00am will be dispatched the same day. All orders placed after 11:00am will be dispatched the next business day - Monday to Friday. The first packages will be shipped from THURSDAY, October 29, 2020.

Delivery time is depending on the delivery option selected and on the final destination.

Shipping costs include handling, packaging and postage fees.

Rate of handling and packaging fees is a fixed amount. Postage fees are depending on the delivery option selected and on the final destination location.

We advise you to group all your items in one single order.

Orders placed separately will not be grouped together afterwards. Shipping cost will be applied as normal to all individual orders.

All packaging boxes have appropriate dimensions for your items to be safely protected and handled.

All orders, regarding of the number of items they contain, avail of the flat rates listed below.


5.2 How are items shipped?


The deliveries are made to the address on the order form. Any details below are required:

-       Access code,

-       The presence of a caretaker,

-       Any other information you consider relevant to the proper delivery of the order.


Delivery at the workplace is recommended if possible.


In the event of error or inaccuracies in the name and address of the buyer, we will not be liable for failure to deliver the order.


The consumer has the choice between a home delivery or a delivery relay depending on the country delivery.


Our partner carriers:


1)    POSTAL SERVICE: home delivery with tracking number and against signature,

2)    POSTAL SERVICE : delivery relay,

3)    CHRONOPOST (express service) : home delivery with tracking number and against signature,

4)    DHL : home delivery with tracking number and against signature.


The package’s number will be sent to you via e-mail address

An email will also be sent by the carrier,

subject to the accuracy of the email address provided by the buyer.


With the package’s number you can at any time track progress on the carrier’s web site.


5.3        Parcel returned to the sender?


If the package is returned to us upon receipt we will make every effort to contact our customer and schedule a new delivery at the customer’s expense. This will be done through the La Poste Colissimo Registered Tracked service regardless of the country of destination.


5.4    Delivery problems?


-       The original packaging is damaged, torn or open at the time of delivery:

You should note the words "Subject to reservation + ground (s)" and check the condition of the item(s). Or refuse the package with a note "refused because opened or damaged" on delivery by the carrier.

You then have a period of three days to inform our company about it. You will need to state in detail the problem identified (e.g. damaged package, already open...)


-       Non delivery of the package on time by the carrier:

You must notify us as soon as possible. We will commence an inquiry of the relevant services and make every effort to ensure that the waiting period is reasonable.




6.   Countries delivery and Delivery costs


The online sale of products on the web site are reserved for customers resident: see Delivery and Returns


A package for the delivery costs will be automatically calculated and will be indicated before confirmation of each order.

7.   Payment methods


The price is payable on order and in a single payment.


You can pay your order safely to K.Jacques Outlet by choosing between 2 secure means of payment.

Any attempt at fraud, for any amount whatsoever and for whatever cause, will be subject to criminal prosecution. The complete information about you will be forwarded to the Draguignan Prosecutor for investigation.

Note that under Article 313-1 of the Penal Code: "Fraud is the fact, whether by use of a false name or a false status, or by abuse of a true status or by the use of deception, of deceiving a person or entity and thus inducing them, to their prejudice or the prejudice of a third party to transfer money, securities or any property, to provide service or to consent to an act of discharge or obligation. Fraud is punishable by five years in prison and a 375,000 Euro fine."


7.1 Payment on web site?


- Bank card : Credit card,Visa, Mastercard, American Express

7.2    The other payment options?


- Bank card manually:

An online payment link will be sent to you so that you can enter your bank details. This will be debited within 72 hours.


We do not accept cash, money orders and cash on delivery.


8. Right to cancellation, returns et refunds


Products marketed within the framework "Private sales K.Jacques" cannot be the object of an exchange or a refund in shop, only the refund of Products via the website being possible.


If the customer retracts within the time limit allowed, we make a commitment to pay off him of all of the paid sums (inclusive transport costs) within 14 days as from the reception of articles in return.


The customer has a period of Forteen days from the date of receipt of the product to exercise his rigexcluding VAT of cancellation.


Did you change your mind, the item doesn’t fit perfectly, the colour is not to your liking or the product doesn’t meet your expectations?


If for any reason you are not completely satisfied with your purchase, you may return unwanted items within 14 days of the date of delivery.


The return procedure is accessible through your personal K.Jacques Outlet account.


1: Log on to your K.Jacques Outlet account.


2: Select « Order history and details».


3: Select the order number with the unwanted item you want to return.


4: Select the item you want to return.


5: Provide a short explanation for the return.


6: Click on « Generate an RMA slip ».


7: Your return request will be saved with your original order.


8: You can then track your return’s status from the “Merchandise returns” tab of your account. Once your return request is authorised, a return receipt (pdf file) will become available. Print it and include it in the parcel when repacking.


You are responsible for postage costs for returning the goods back to us. You can use your preferred postal service, but we recommend you to ask for a proof of postage in case the parcel goes missing on its way back to us. We will not be held accountable and will not refund any lost parcels. The parcel remains the customer’s responsibility until it reaches us.

Products must be returned in their original condition, unworn, uncleaned and in their original boxes.

Any item returned to us that does not meet our returns policy will not be refunded by K.Jacques Outlet (Keklikian SA).

Every item returned will go through inspections and once approved an email will be sent to you.


9.   Warranty


All products supplied by Etablissements KEKLIKIAN, benefit from the legal warranty under article 1641 onwards of the Civil Code.

In the case of the non-compliance of a product sold, it can be returned to the vendor who will take it back, exchange it or give a refund.

All claims, requests for exchanges or refunds must be made in advance (see Article 11 "Contact Us").

In the on line sale process, Etablissements KEKLIKIAN is only obliged to use best endeavours, it cannot be held liable for damages resulting from the use of the Internet such as data loss, intrusion, virus, interruption of service, or other problems beyond our control.




12.               Intellectual property


Any components of Etablissements KEKLIKIAN's web site are and remain the exclusive intellectual property of Etablissements KEKLIKIAN.


No one is allowed to reproduce, use, redistribute, or use for any purpose whatsoever, even in part, any component of the web site whether software, visual or sound.

Any single link or hyperlink is strictly prohibited without written consent from Etablissement KEKLIKIAN.

As such, in accordance with the Intellectual Property Code, private use only is authorized, subject to any different, more restrictive provisions in the Intellectual Property Code. Reproduction in whole or part of Etablissements KEKLIKIAN’s web site is strictly prohibited without prior agreement.




13.               Personal data


Etablissements KEKLIKIAN does not use the services of third-party advertising companies who display advertisements when you visit our web site, and does not transmit the information in its customer database to commercial partners.




14.               Archiving, Evidence


Etablissements KEKLIKIAN archive purchase orders and invoices on a reliable and durable medium as a true copy in accordance with the provisions of section 1348 of the Civil Code.


Etablissements KEKLIKIAN’s records will be regarded by the parties as proof of the communications, orders, payments and other transactions between the parties.
